General Terms and Conditions (AGB) of aledu GmbH

 

I. General

For reasons of better readability, the following text does not use both female and male language forms and uses the generic masculine form. All references to persons apply equally to both genders.

 

1 Validity of the General Terms and Conditions

The following terms and conditions of aledu GmbH apply as the basis for the conclusion of contracts for all services / products offered on the website www.aledu.de, in particular language tuition and examinations.

 

§ 2 Participation requirements

Participants at aledu GmbH must be at least 18 years old. Minors may not register independently. Special conditions apply to them, which must be agreed with their legal guardian. The registration form for minors must be signed by their legal guardian.

 

§ 3 Liability

3.1. aledu GmbH accepts no liability for accidents on the way to the examination/course or during the examination/course or afterwards. Participants are liable for all damage caused by them and are obliged to pay compensation in accordance with the applicable legal provisions. The organiser is not liable for any damages, including injuries on the occasion of excursions.

3.2 Participation in excursions organised by us is at your own risk.

3.3 For minors, the legal guardians are liable.

3.4 Course participants are not covered by accident or health insurance on the part of aledu GmbH.

3.5. aledu GmbH accepts liability for personal injury only within the scope of the statutory provisions.The exclusion of liability does not apply to injury to life, limb or health that is based on a negligent breach of duty by the legal representative or an intentional or negligent breach of duty by a supervisory staff member of aledu GmbH. Furthermore, other damages based on an intentional or grossly negligent breach of duty by a legal representative or supervisory staff of aledu GmbH are excluded from the exclusion of liability.

3.6. aledu GmbH accepts no liability for theft or damage to property within the school.

3.7. aledu GmbH is not liable for the availability and accessibility of www.aledu.de.

3.8. aledu GmbH is also not liable for the non-achievement of a certain learning and seminar success.

3.9. aledu GmbH is furthermore not liable for the cancellation of individual seminar modules due to force majeure. The liability of aledu GmbH due to mandatory statutory provisions remains unaffected.

 

§ 4 Duties of the Participant

3.1 The participant undertakes to observe the course and house rules of the educational institution aledu GmbH.

3.2 The participant himself is responsible for a legal stay in the Federal Republic of Germany and his insurance coverage.

Kurs- und Hausordnung

  1. Die Schul- und Hausordnung gilt für alle Personen, die sich in den realen & virtuellen Räumlichkeiten von  aledu GmbH aufhalten.
  2. Das Hausrecht wird von der Geschäftsführung von aledu GmbH ausgeübt.
  3. Ist die Geschäftsführung abwesend oder verhindert, vertritt sie darin der Assistent der Geschäftsführung oder ein Teammitglied der Kundenberatung.
  4. Bei aledu GmbH wird die Würde aller Beteiligten geachtet. Weder Lehrer:innen, Schüler:innen noch Eltern und alle anderen, die zur Schulgemeinschaft gehören, dürfen in ihrer körperlichen und geistig-psychischen Unversehrtheit gefährdet, verletzt oder missachtet werden. Ausgrenzung, Intoleranz und verbale Übergriffe dulden wir nicht.
  5. Bei aledu GmbH darf niemand aufgrund der eigenen Hautfarbe, Abstammung, Geschlechts oder Glaubens wegen benachteiligt oder bevorzugt werden. Schüler:innen, Lehrkräfte und Angestellte sind hierin gleichberechtigt zu behandeln. Auf dieser Basis übt aledu GmbH das Hausrecht aus. Menschen, die rechtsextremes, rassistisches, antisemitisches oder antidemokratisches Gedankengut verbreiten, sind auszuschließen. Wer gegen die genannten Grundsätze erkennbar verstößt, wird des Hauses verwiesen. aledu GmbH behält sich in diesem Rahmen auch vor, die Verfügbarkeit des Schulprogramms oder Lehraufträge oder Angestelltenverhältnisse dementsprechend zu regulieren.
  6. Das Mitbringen gefährlicher Gegenstände oder Materialien, die nach Art oder Inhalt geeignet sind, Dritte aufgrund ihrer Hautfarbe, Religion, ihres Geschlechts oder ihrer sexuellen Orientierung zu diffamieren oder Menschen zu attackieren, ist verboten.
  7. Das Prinzip der Verantwortung in der Schule verlangt von jedem, für sein Tun und Nichttun einzustehen. Mit dem Eigentum der aledu GmbH ist sinnvoll und pfleglich umzugehen; ebenso ist das Eigentum der anderen zu achten. Wer etwas beschmutzt, beschädigt oder zerstört, muss für den Schaden aufkommen. Fälle vorsätzlicher Sachbeschädigung und gravierender Verunreinigung werden zur Anzeige gebracht.
  8. Besucher:Innen unserer Schule melden sich an der Rezeption an.
  9. Bei schweren Verstößen gegen die Schul- und Hausordnung können Personen ohne Entschädigung vom Unterrichtsbetrieb ausgeschlossen und mit einem Hausverbot belegt werden.
  10. Alle strafbaren Handlungen oder sonstigen Ordnungswidrigkeiten führen zur Anzeige.

§ 5 Data protection

Within the framework of the general data protection law, the organizer is entitled to store and archive the personal data of the participant on electronic media. The organiser undertakes to comply with the provisions of the Data Protection Act.

The personal data will only be used for internal processing and for aledu GmbH's own advertising purposes in compliance with the legal conditions. Reference is made to the data protection regulations at www.aledu.de.

 

II. Courses

§ 1 Registration & Payment

1.1 Registration for the courses can be done online or in person. The participant completes the registration form or online form in full and sends it to aledu GmbH.

1.2 After payment of the registration fee of 80 Euro, which has to be paid either personally on site or by bank transfer, the participant will receive a confirmation of registration. The prices valid at the time of the conclusion of the contract are always applicable. These can be found on the homepage of aledu GmbH. All prices and any applicable fees are in Euro. Additional costs, such as bank charges, etc., shall be borne by the participant.

1.3 The registration and course fees should be paid in full at least two weeks before the start of the course either in person on site or into the account of aledu GmbH: IBAN: DE85440100460804024464. A binding registration for a course is only deemed to have been made when the participant has made the necessary payments and received confirmation of registration from aledu GmbH.

1.4 Participants abroad who require a visa should register at least two months before the start of the course. In this case the course fee(s) should be paid in advance.

 

§ 2 Cancellation

2.1 The course can be cancelled in writing at least 14 days before the course starts. The start of the course is the date stated on the confirmation of registration. In this case the registration fee will not be refunded. In the event of cancellation at a later date, the participant has no right to a refund.

2.2 If the visa from the country of origin is refused, the participant may cancel the booked course even after the course has started when the notice of refusal is delivered by the competent authority and the course fee(s) paid will be refunded. aledu GmbH will in this case retain only a one-off processing fee of EUR 80.

2.3 Upon receipt of the required visa (with the confirmation of registration from aledu GmbH) there will be no cancellation or refund.

 

§ 3 Transfer

A rebooking to a later course can be made at least 14 days before the start of the course. This must be done in writing. In this case aledu GmbH will charge a rebooking fee of 50 euros.

 

§ 4 Course assignment

4.1 Assignment to a course level is based on a placement test at aledu GmbH itself.

4.2 aledu GmbH's management shall determine the syllabus and the distribution of the courses in the morning and afternoon. There is no entitlement to a course at a specific time of day.

4.3. aledu GmbH reserves the right to change the course time or to change the teacher.

 

§ 5 Conditions of implementation

5.1 Each intensive course level (A1-C2) at aledu GmbH generally comprises approximately 200 teaching units, whereby one teaching unit is 45 minutes.

5.2. Die Kurse werden in der Regel mit mindestens 12 Teilnehmenden durchgeführt, ansonsten behält sich aledu GmbH vor, die Stundenzahl zu reduzieren, den Kurs umzubuchen oder abzusagen.

5.3 In case of cancellation or postponement of the course for organisational reasons, the entire course fees will be refunded. There is no right to compensation for damages. Should a teacher fall ill, a replacement will be organised on the third day at the latest.

5.4 On public holidays of the State of NRW, no lessons are held. The missed lessons will not be refunded and will not be made up at another time. The teacher may arrange different course dates with the students.

5.5 If face-to-face teaching is no longer possible due to a pandemic (e.g. a virus), aledu GmbH reserves the right to switch the entire school programme to online teaching. Cancellation or rebooking are excluded in this case.

aledu GmbH follows the guidelines of the public health department and recommendations of the Robert Koch Institute to set offline courses online in case of a Cov19 positive tested person in the course or in case of a suspicion of Corona (in case of temporary observation of symptoms). This is done until the end of the isolation and quarantine period (currently: 14 days) or at least until the negative Cov19 test results of all course participants are available. The follow-up course can take place offline again, under the aforementioned conditions.

The offer of virtual classes is completely equivalent to the offer of real classes: same time, same duration, same period, same level, same content, German language skills at the end of the course identical to face-to-face classes.

 

§ 6 Course materials

Costs incurred for the purchase of course books and teaching materials are not included in the course fee and must be paid separately.

 

§ 7 Final Examination & Certificate

7.1 The internal final examination takes place at the end of the course. In the event of nonattendance, the right to a final certificate shall lapse. For a fee of 50 Euro the final examination can be taken on an individual desired date.

7.2 Upon successful completion of the final examination, the participant receives a certificate for the corresponding level from the educational institution aledu GmbH.

7.3 If a participant fails the final examination, he can repeat it at a reduced rate for a fee of 50 Euro.

7.4 The reissue of the certificate due to loss or similar costs 30 Euro.

 

§ 8 Irregular presence

In case of irregular attendance at the course, there will be no refund of course fees and no extension of the course.

 

III. aledu-examination

§ 1 Registration

aledu examinations take place every Friday. The registration deadline for each exam is 3 days before the exam date. You can register either online or in person.

 

§ Section 2 Payment

The aledu exam costs 150 euros per level, which must either be paid in cash or transferred before the exam.

 

§ 3 Cancellation & Rebooking

Cancellation or rebooking is possible 3 days before the examination date at the latest.

 

§ 4 Deception

4.1 The participant must be able to prove his identity by means of a photo identification.

4.2 All aids, such as dictionaries, mobile phones, but also wearables, such as wristwatches or glasses with recording function, are not permitted.

4.3 The participant has to perform independently, therefore memorizing sample texts will be evaluated with zero points.

4.4 If deception is detected, the participant will be immediately excluded from the test. The examination performance will not be evaluated.

 

§ 5 Repeat examination

The failed subtests can be repeated as often as desired within 3 months. A subtest costs 50 euros.

 

§ 6 Certificate

The notification of results takes one week after the examination date. In exceptional cases it can take up to two weeks. For an additional fee of 30 Euro the result and, if passed, the certificate can be received directly on the following Monday.

 

IV. telc examination

§ 1 Registration & Payment

1.1 Registration for the telc exam can be done either online or in person.

1.2 After registration, the participant receives a confirmation of registration from aledu GmbH. Upon receipt of the confirmation of registration, the participant will receive a request for the examination fee to be paid. The prices valid at the time the contract is concluded shall always apply. These can be found on the homepage of aledu GmbH.

1.3. Die Prüfungsgebühr soll spätestens 14 Tage vor der Prüfung in voller Höhe gezahlt werde. Danach sind keine Anmeldungen sowie Zahlungen möglich.
§ 2 Stornierung

2.1 Cancellation of registration for the examination is not possible.

2.2 A transfer of the place to another person is possible. The participant is responsible for this.

 

§ 3 Deception

3.1 The participant must be able to prove his identity by means of a photo identification.

3.2 All aids, such as dictionaries, mobile phones, but also wearables, such as wristwatches or glasses with recording function, are not permitted.

3.3 The participant has to perform independently, therefore memorizing sample texts will be evaluated with zero points.

3.4 If deception is detected, the participant will be immediately excluded from the test. The examination performance will not be evaluated.

 

§ 4 Repeat examination

4.1 The examinee is entitled to the crediting of his last partial result achieved, i.e. he can make up for or repeat the oral or written exam until the end of the following calendar year.

4.2 The prices for partial examinations are listed on the aledu GmbH homepage.

 

§ 5 Certificate

5.1 If the participant has passed the examination, he will receive a certificate.

5.2 In the event of failure, he or she will receive a score sheet.

5.3 The results are available after about three to five weeks.

 

§ Article 6 Implementing provisions

6.1 The participant accepts the general terms and conditions / examination regulations of telc gGmbH.

6.2 Rules and Regulations for Examination Security: Examination materials belong to telc GmbH and may under no circumstances be retained or copied. The notepaper must also be returned to aledu.

6.3 The supervisors may provide information on formalities and instruct on audit assurance. They may answer questions about the organisation of the audit. No comments may be made on any questions concerning the content of the examination. No questions may be answered after the start of the examination.

6.4 If a participant arrives at the test after the time specified by aledu GmbH, he may not take part in the test under any circumstances. The examination begins with the written part. This is followed by the oral examination.

6.5 At the beginning of the oral examination all candidates must be in the building. If a candidate has left the building and has not returned at the agreed time, he/she may not take part in the oral examination.

6.6 All electronic devices remain with aledu GmbH until the oral examination is completed.

6.7 In the event of non-acceptance of the above rule, the participant will be excluded from further testing and must leave the building immediately.

 

§ 7 Final provisions 

7.1 The exclusive place of jurisdiction for all disputes arising from contracts concluded with aledu GmbH is Duisburg if the participant is a merchant or a legal entity under public law. Otherwise, the statutory places of jurisdiction apply.

7.2 Should any provision of these Conditions of Participation be invalid, this shall not affect the validity of the remaining provisions.

7.3 Amendments and supplements to the contract must be made in writing.
