General Terms and Conditions (GTC) of aledu GmbH

 

I. General

For reasons of better readability, the simultaneous use of feminine and masculine forms of speech is dispensed with in the following and the generic masculine is used. All personal designations apply equally to both genders.

 

§ 1 Validity of the General Terms and Conditions

The following terms and conditions of aledu GmbH apply as the basis for the conclusion of contracts for all services / products offered on the website www.aledu.de, in particular language lessons and examinations.

 

§ 2 Participation requirements

Participants at aledu GmbH must be at least 18 years old. Minors are not allowed to register independently. Special conditions apply to you, which must be agreed with the legal guardian. The registration form for the minors must be signed by the parent or guardian.

 

§ 3 Liability

3.1. aledu GmbH assumes no liability for accidents on the way to the exam/course as well as during the exam/course or afterwards. Participants are liable for all damages caused by them and are obliged to pay compensation in accordance with the applicable legal provisions. The organizer is not liable for any damages, including injuries during the excursions.

3.2. Participation in excursions organized by us is at your own risk.

3.3. For minors, the legal guardians are liable.

3.4. Course participants are neither accident nor health insured on the part of aledu GmbH.

3.5. aledu GmbH assumes liability in case of personal injury only within the scope of the statutory provision.The exclusion of liability does not apply to injuries to life, body or health that are based on a negligent breach of duty by the legal representative or an intentional or negligent breach of duty by a supervisory staff of aledu GmbH. Furthermore, the exclusion of liability does not apply to other damages that are based on an intentional or grossly negligent breach of duty by a legal representative or supervisory personnel of aledu GmbH.

3.6. aledu GmbH assumes no liability for theft and damage to property within the school.

3.7. aledu GmbH is not liable for the availability and accessibility of www.aledu.de.

3.8. aledu GmbH is also not liable for the non-achievement of a certain learning and seminar success.

3.9. Furthermore, aledu GmbH is not liable for the cancellation of individual seminar modules due to force majeure. The liability of aledu GmbH based on mandatory statutory provisions remains unaffected.

 

§ 4 Duties of the participant

3.1. The participant agrees to comply with the course and house rules of the educational institution aledu GmbH.

3.2. The participant himself is responsible for a legal stay in the Federal Republic of Germany and his insurance coverage.

Course and house rules

  1. The school and house rules apply to all persons who are on the real & virtual premises of aledu GmbH.
  2. The domiciliary rights are exercised by the management of aledu GmbH.
  3. If the management is absent or prevented, the assistant to the management or a team member of the customer advisory service represents them in this.
  4. At aledu GmbH, the dignity of all participants is respected. Neither teachers, students, parents nor anyone else who is part of the school community may be endangered, injured or disrespected in their physical and mental integrity. We do not tolerate exclusion, intolerance and verbal abuse.
  5. At aledu GmbH, no one may be discriminated against or given preferential treatment on the basis of their skin color, ancestry, gender or faith . Students, faculty and staff shall be treated equally in this regard. On this basis, aledu GmbH exercises the domiciliary rights. People who spread right-wing extremist, racist, anti-Semitic or anti-democratic ideas are to be excluded. Anyone who recognizably violates the above principles will be expelled from the premises. In this context, aledu GmbH also reserves the right to regulate the availability of the school program or teaching assignments or employment relationships accordingly.
  6. It is forbidden to bring dangerous objects or materials which, by their nature or content, are likely to defame third parties on the basis of their skin color, religion, gender or sexual orientation, or to attack people.
  7. The principle of responsibility in school requires everyone to take responsibility for their actions and inactions. The property of aledu GmbH is to be handled sensibly and with care; the property of others is also to be respected. Anyone who soils, damages or destroys something must pay for the damage. Cases of intentional damage to property and serious pollution will be reported to the police.
  8. Visitors:Inside our school register at the reception.
  9. In the event of serious violations of school and house rules, persons may be excluded from classes without compensation and banned from the premises.
  10. All criminal acts or other administrative offenses will be reported to the police.

§ 5 Data protection

Within the framework of the General Data Protection Act, the organizer is entitled to store and archive the personal data of the participant on electronic media. The organizer undertakes to comply with the provisions of the Data Protection Act.

The personal data will only be used for internal processing and for aledu GmbH’s own advertising purposes in compliance with the legal conditions. Reference is made to the data protection provisions at www.aledu.de.

 

II. Courses

§ 1 Registration & Payment

1.1. You can register for the courses or individual modules online or in person. The participant fills out the registration form or the online form completely and sends it to aledu GmbH.

1.2. After payment of the registration fee of 80 euros, which must be paid at the time of registration either in person on site or by bank transfer, the participant can receive a confirmation of registration. The prices valid at the time of the conclusion of the contract shall always apply. These are available on the homepage of aledu GmbH. All prices and any applicable fees are in Euro. Additional costs, such as bank charges, etc., are borne by the participant.

1.3. The registration fee as well as the course fee should be paid in full at least two weeks before the course starts either in person on site or to the account of aledu GmbH: IBAN: DE85440100460804024464. A binding registration for a course has only been made when the participant has made the required payments and received a confirmation of registration from aledu GmbH.

1.4. Participants abroad who need a visa should register at least two months before the course begins. In this case, the course fee(s) should already be prepaid.

 

§ 2 Cancellation

2.1. The course can be cancelled in writing at least 14 days before the course starts. The registration fee will not be refunded in this case. In case of cancellation at a later date, the participant is not entitled to a refund.

2.2. The course cannot be canceled or terminated after the start of the course or module.

2.2. In case of visa refusal from the country of origin, the participant can cancel the booked course even after the beginning of the course when receiving the refusal notice from the competent authority and get the paid course fee(s) refunded. aledu GmbH retains in this case only a one-time processing fee of 80 euros.

2.3. Upon receipt of the required visa (with the registration confirmation from aledu GmbH) there will be no cancellation and no refund.

 

§ 3 Rebooking

A rebooking to a later course can be made at the latest 14 days before the course starts. This must be done in writing. In this case, aledu GmbH will charge a rebooking fee of 50 euros.

 

§ 4 Course assignment

4.1. Assignment in a course level is based on a placement test at aledu GmbH itself.

4.2. The schedule of classes as well as the distribution of classes in the morning or afternoon is determined by the management of aledu GmbH. There is no entitlement to a course at a specific time of day.

4.3. There is no entitlement to be taught by a particular teacher or with a particular book. Any change of teacher or book does not entitle the student to terminate or withdraw from the contract.

4.3. aledu GmbH reserves the right to change the course time or to change the teacher.

 

 

§ 5 Implementation conditions

5.1. Each intensive course level (A1-C2) at aledu GmbH usually consists of approximately 200 teaching units, with one teaching unit lasting 45 minutes.

5.2. The courses are usually held with a minimum of 14 participants, otherwise aledu GmbH reserves the right to reduce the number of hours, rebook or cancel the course.

5.3. In case of cancellation or postponement of the course for organizational reasons, the full course fees will be refunded. There is no right to compensation for damages. If a teacher falls ill, a substitute will be organized no later than the third day.

5.4. There are no classes on public holidays in the state of NRW. Classes that are cancelled will not be refunded or made up at another time. The instructor may arrange alternate course dates with students.

5.5. If face-to-face teaching is no longer possible due to a pandemic (e.g. a virus), aledu GmbH reserves the right to switch the entire school program to online teaching. Cancellation or rebooking are excluded in this case.

aledu GmbH follows the guidelines of the public health department and recommendations of the Robert Koch Institute to set offline courses online in case of a Cov19 positive tested person in the course or in case of suspicion of Corona (in case of temporary observation of symptoms). This will be done until the end of the isolation and quarantine period (currently: 14 days) or at least until the negative Cov19 test results of all students are available. The follow-up course can take place offline again, under the aforementioned conditions.

The offer of virtual classes is completely equivalent to the offer of real classes: the same time, the same duration, the same period, the same level, the same content, knowledge of German at the end of the course identical to face-to-face classes.

 

§ 6 Course materials

Costs incurred for the purchase of course books and teaching materials are not included in the course fee and must be paid separately.

 

§ 7 Final examination & certificate

7.1. The internal final exam takes place at the end of the course and costs an additional €59. In the event of non-entry, the right to a certificate of completion is forfeited. For a fee of 50 euros, the final exam can be taken on an individual desired date.

7.2. Upon successfully passing the final exam, the participant will receive a certificate for the corresponding level from the educational institution aledu GmbH.

7.3. If the participant does not pass the final exam, he/she can repeat it at a reduced rate for a fee of 50 euros.

7.4. Re-issuance of the certificate due to loss or similar costs 30 euros.

 

§ 8 Irregular attendance

In case of irregular attendance in the course, there will be no refund of course fees and no extension of the course.

§ 9 Individual lessons

9.1. The term “individual tuition” refers to both face-to-face and virtual or other forms of one-to-one tuition offered by aledu GmbH. The individual lesson plan is determined between the participant and aledu GmbH.

9.2. You can register for private lessons online or in person. The participant fills out the registration form or the online form completely and sends it to aledu GmbH.

9.3. After receipt of payment, aledu GmbH will organize a teacher within 7 working days. During this time, there is no entitlement to a refund or cancellation.

9.4. Appointments must always be arranged personally with the teacher. Cancellation of the lesson by the participant should be made 48 hours before the appointment with the teacher.

9.5. Lesson time missed due to the teacher’s fault is made up or given, the teacher
offers either alternative dates (up to two) to choose from. The teaching time missed by the teacher
but can also be recovered through longer teaching units. If it is not possible for the teacher to make up the lessons later or earlier, the lessons will be reimbursed.

9.6. The complete booking of all dates can be canceled up to 7 days before the first agreed date and a refund of 80% of the fees already paid can be received.

 

III. aledu exam

§ 1 Application

aledu exams are held every Friday. The registration deadline for each exam is 3 days before the exam date. Registration can be done either online or in person. An additional fee of 20 euros will be charged for late registration.

 

§ 2 Payment

The aledu exam costs 160 euros per level, which must be paid either in cash or by bank transfer before the exam.

 

§ 3 Cancellation & Rebooking

Cancellation or rebooking is possible at least 3 days before the exam date. In this case, aledu GmbH will charge a rebooking or cancellation fee of 30 euros.

A rebooking for technical reasons caused by the examinee is 20 euros.

§ 4 Deception

4.1. The participant must be able to prove his identity with the help of a photo ID.

4.2. All aids, such as dictionaries, cell phones, but also wearables, such as wrist watches or glasses with recording function, are not allowed.

4.3. The participant must perform independently, therefore memorization of sample texts, will also be assessed zero points.

4.4. If cheating is detected, the participant will be immediately excluded from the examination. The examination performance is not evaluated.

 

§ 5 Retesting

The failed subtests can be repeated any number of times within 3 months. A subtest costs from 50 euros. If the booked exam is not passed within 3 months, the participant is obliged to take the whole exam again.

 

§ 6 Certificate

Notification of results takes about 3-4 weeks after the examination date. In exceptional cases it can take up to 5 weeks. For an additional fee of 30 euros, the result and, if passed, the certificate can be issued within a maximum of 30 days. 3 working days are received.

 

IV. telc exam

§ 1 Registration & Payment

1.1. You can register for the telc exam either online or in person.

1.2. After registration, the participant will receive a confirmation of registration from aledu GmbH. Upon receipt of the registration confirmation, the participant will receive the request for the examination fee to be paid. The prices valid at the time of the conclusion of the contract shall always apply. These are available on the homepage of aledu GmbH.

1.3. The examination fee must be paid in full no later than 14 days before the examination. After that, no registrations as well as payments are possible.

§ 2 Cancellation

2.1. Cancellation of the telc exam is only possible up to 14 days (by 3.30 pm) before the exam date. In this case, 80% of the examination fees will be refunded.

2.2. Cancellation is no longer possible thereafter.

2.2. Transfer of the seat to another person is possible. The participant is responsible for this.

§ 3 Rebooking

3.1. It is only possible to change the exam to another date up to 15 days before the exam date.

3.2. In this case, aledu GmbH will charge a rebooking fee of €50.

 

§ 4Deception

4.1. The participant must be able to prove his identity with the help of a photo ID.

4.2. All aids, such as dictionaries, cell phones, but also wearables, such as wrist watches or glasses with recording function, are not allowed.

4.3. The participant must perform independently, therefore memorization of sample texts, will also be assessed zero points.

4.4. If cheating is detected, the participant will be immediately excluded from the examination. The examination performance is not evaluated.

 

§ 5 Retesting

The examinee is entitled to credit for his or her last partial result, i.e. he or she can make up or repeat the oral or written examination until the end of the following calendar year.

 

§ 6 Certificate

6.1. If the participant passes the exam, he will receive a certificate.

6.2. In case of failure, he will receive a result sheet.

6.3. The results are available after about 3 to 6 weeks.

 

§ 7 Implementing provisions

7.1. The participant accepts the general terms and conditions/examination regulations of telc gGmbH.

7.2. Examination security regulations: Examination materials belong to telc GmbH and may not be kept or copied under any circumstances. The notepaper must also be returned to aledu.

7.3. Supervisors may provide information on formalities and instruct on examination security. Questions about the organization of the exam may be answered. Any questions regarding the content of the exam may not be commented on. No questions may be answered after the exam has begun.

7.4. If a participant shows up for the exam after the time specified by aledu GmbH, he/she will not be allowed to take part in the exam under any circumstances.

7.5. At the beginning of the oral examination, all examinees must be in the building. If a participant has left the building and has not returned at the agreed time, he/she will not be allowed to participate in the oral examination.

7.6. All electronic devices remain with aledu GmbH until the completion of the oral examination.

7.7. In case of non-acceptance of this above rule, the participant will be excluded from further examination and must leave the building immediately.

V. ÖSD examination

§ 1 Registration & Payment

1.1. You can register for the ÖSD exam either online or in person.

1.2. After registration, the participant will receive a confirmation of registration from aledu GmbH. Upon receipt of the registration confirmation, the participant will receive the request for the examination fee to be paid. The prices valid at the time of the conclusion of the contract shall always apply. These are available on the homepage of aledu GmbH.

1.3. The examination fee must be paid in full no later than 15 days before the examination. After that, no registrations as well as payments are possible.

§ 2 Cancellation

2.1. Cancellation of the ÖSD exam is only possible up to 15 days (by 3.30 pm) before the exam date. In this case, 80% of the examination fees will be refunded.

2.2. Cancellation is no longer possible thereafter.

7.7. In case of non-acceptance of this above rule, the participant will be excluded from further examination and must leave the building immediately.

 

§ 8 Final provisions

8.1. The exclusive place of jurisdiction for all disputes arising from contracts concluded with aledu GmbH is Duisburg, Germany, if the participant is a merchant or a legal entity under public law. In all other respects, the statutory places of jurisdiction shall apply.

8.2. Should any provision of these Terms and Conditions of Participation be invalid, this shall not affect the validity of the remaining provisions.

8.3. Changes and additions to the contract must be made in writing.
